Phil heads up our Inheritance and Trust Disputes Team.  Phil is based in Exeter.  He is highly ranked in both Legal 500 and Chambers in his specialist practice area of contested probate.

Phil qualified in January 1993 and has over 20 years experience in dealing with inheritance and trust disputes.  After spending six years working in the scientific civil service Phil gained an Upper Second Law Degree from Exeter University in 1989 and shortly thereafter began his career with Stephens Scown LLP as a trainee.

Phil is a member of the Association of Contentious Probate and Trust Specialists (ACTAPS) and his specialist expertise includes:

  • Bringing claims or defending claims under the Doctrine of Proprietary Estoppel often brought by adult children who assert ownership of all or part of a farm having carried out work on the understanding that they would receive an interest in it.
  • Bringing or defending claims brought by disappointed beneficiaries under the Inheritance (Provision for Family and Dependants) Act 1975.
  • Assisting Executors and Trustees to resolve conflicts which have arisen during the course of administering a trust or an estate.
  • Challenging the validity of a Will or defending a challenge, brought on the grounds of lack of testamentary capacity, undue influence, want of knowledge and approval or as a result of a failure to duly execute.

Most of Phil’s work involves complex high value claims or where a business is involved, often a farming partnership.

Phil has attended many mediations and is a great advocate of the mediation process.

Outside of the office Phil enjoys cycling both on and off road, walking and attending live music events and festivals with his wife in their campervan.
