As you may have heard, the UK is leaving the EU.  With this change, all EU, EEA and Swiss citizens and their family members who wish to continue living in the UK after 29 March 2019 will be required to make an application to the EU Settlement Scheme to secure their status in the UK.

Under the current test phase of the EU Settlement Scheme, open only to EU citizens with a valid EU passport and access to an android phone, the Home Office have reported that nearly 200,000 people have received confirmation of their status so far.  The scheme is due to be fully open by 30 March 2019.

 

What am I applying for?

When making an application to the EU Settlement Scheme, individuals will be considered for Settled or Pre-Settled Status.  This is effectively, Infinite Leave to Remain or Leave to Remain in the UK.  An individual who has been resident in the UK for a continuous period of five years, will be considered for Settled Status. Whereas individuals who have been in the UK for a shorter period of time will be considered for Pre-Settled Status, with the opportunity to make applications for Settled Status once they have the required five years residence.

If an individual is granted Pre-Settled or Settled Status, they’ll be able to:

  • Work or continue working in the UK
  • Use the NHS
  • Enrol in education or continue studying
  • Access public funds such as benefits and pensions, if eligible for them
  • Travel in and out of the UK

 

The deadline for making an application to the EU Settlement Scheme is 30 June 2021, or 31 December 2020 if the UK leaves the EU without a deal.
