Simon is a partner in the commercial property team in St Austell. Having previously worked in the firm’s Exeter office for over 10 years, much of his work is spread across the South West. He acts in relation to general commercial property matters (for example, freehold acquisitions and disposals and commercial leases).

Simon’s particular focus is in the mines and minerals sector where he acts for both mineral operators and landowners in the preparation and negotiation of agreements relating to mineral extraction including mineral leases, options for mineral leases, freehold acquisition and sale of minerals, prospecting licences, and also agreements relating to end of life uses such as infill licences. He also advises the secured lending sector, acting for a number of private lenders.

His work includes:

  • devising a legal structure to enable the working of mines and minerals as one operation even though legal ownership and the intended working was to be between multiple parties. This included as series of minerals leases, option agreements, and licences in order to achieve our client’s commercial objectives
  • creating a slick secured lending procedure with bespoke security documents for a client in the secured lending sector to maximise the speed and efficiency of matters being completed and minimise the risk of fraud. This has now been employed on over 100 transactions
  • acting for a private lender taking security over a development site to fund the construction of over 25 dwellings with a loan facility in excess of £2.5million. There were numerous issues along the way including construction issues and contractual disputes and a series of variations to the original agreements. As such nearly every team in the firm was involved at one stage or another. The scheme was successfully completed and lending repaid and was successful for the lender (and borrower)
  • addressing an array of title issues for a mineral operator over their land holding including one of the largest land registrations in the South West at the time. This work enables the operator to continue with its mineral operations and allows for future diversification of its landholding

Simon loves being outdoors and in his spare time enjoys windsurfing, golf, surfing and cycling.
