What is a final hearing in a divorce?

A final hearing in relation to a divorce can occur where the respondent has defended the divorce and no agreement is reached about how the issue of a divorce is to be resolved. In that situation, the Court will need to make a decision for the parties to the marriage about whether there should be a divorce. This is done at the final hearing. The Court will hear from the parties either as submissions (arguments) and/or in evidence (where the parties give evidence to the Court orally and are asked questions). The Judge will then make a decision about whether there should be a divorce.
