The Supreme Court has recently handed down judgement in the case of Lewis -v- Redcar and Cleveland Borough Council.
In essence, the Supreme Court has decided that the use of part of the golf course by members of the public as a place of public access was not defeated by their deference to members of the golf club playing golf. Waiting out of the way and allowing golfers to "play through" the area in question was not an interruption of the public's assertion of rights to use the land for public leisure purposes.
The decision has very serious implications for landowners.
