Employing Foreign Nationals

Many businesses in the UK employ foreign nationals.  It can sometimes be a complex process, but at Stephens Scown we have experience in working with both employers and employees to navigate through Tier One and Two of the points based system.

Businesses wanting to employ anyone from outside the European Economic Area and Switzerland will need to go through the 5 tier Points Based System, which makes employers accountable for the registration and monitoring of their foreign workers.

Stricter penalties of up to a £10,000 fine for each illegal worker and a prison sentence of up to 2 years can be imposed on those employers who fail to comply and are found to have employees working illegally – so it is vital to have the right legal advise from the outset.

Under the Points Based System, migrants will need to pass a points-based assessment before they are given permission to enter or remain in the UK. All workers and students, other than those under Tier 1 (highly skilled migrants) will need to be sponsored.

In order to become a sponsor you, as an employer or educational institution, will need to be licensed by the UK Border Agency.  We can advise employers and educational institutions on complying with this complex criteria.
